7. User Contributions

BestForPets.org may contain interactive features, including message boards, chat rooms, personal web pages or profiles, forums, review and ratings sections, and bulletin boards (collectively, “Interactive Services”). These Interactive Services allow users to post, submit, publish, display or transmit to other users or other persons (hereinafter, “post”) comments, content or other materials (collectively, “User Contributions”) on or through the Site.

You should be aware that if you voluntarily disclose personal information (such as your username or email address) on BestForPets.org, such as on a forum, chat room, or on any other user-generated pages, that information may be viewed in search engines, collected and used by others, and may result in unsolicited contact from other parties. We strongly advise against posting any personal or sensitive information on our Site.

Any User Contribution that you post to the Site will be considered non-confidential and non-proprietary. By providing any User Contribution on the Site, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors and assigns, the perpetual right to use, reproduce, modify, perform, display, distribute and otherwise disclose to third parties any such material for any purpose.

7.1 You represent and warrant that:​

  • You own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their and our respective licensees, successors and assigns.

You are solely responsible for any User Contributions you submit or contribute, and you, not BestForPets.org, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness. We are not responsible, or liable to any third party, for the content or accuracy of any User Contributions posted by you or any other user of the Site.

7.2 Monitoring and Enforcement; Termination:

We have the right to:

  • a) Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
  • b) Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the content standards below, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Site or the public, or could create liability for BestForPets.org.
  • c) Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  • d) Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Site.
  • e) Terminate or suspend your access to all or part of the Site for any or no reason, including without limitation, any violation of these Terms of Use.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information related to anyone posting any materials on or through the Site. You waive and hold harmless BestForPets.org and its affiliates, agents, licensees and service providers from any claims resulting from any action taken by any of the foregoing parties during or as a result of its investigations and from any actions taken as a consequence of investigations by either BestForPets.org/such parties or law enforcement authorities.

We cannot and do not undertake to review all material before it is posted on the Site, and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any

7.3 Content Standards

The Content Standards outlined below apply to all User Contributions and the use of Interactive Services on the Site. User Contributions must fully comply with all applicable laws and regulations at the federal, state, local, and international levels. Additionally, User Contributions must not:

  • a. User Contributions must not contain defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable material.
  • b. User Contributions must not promote sexually explicit or pornographic content, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
  • c. User Contributions must not infringe upon the intellectual property or other rights of any other person, including patents, trademarks, trade secrets, and copyrights.
  • d. User Contributions must not violate the legal rights of others, including their right to publicity and privacy, or contain material that could result in civil or criminal liability under applicable laws or regulations, or that may conflict with our Terms of Use and Privacy Policy.
  • e. User Contributions must not be likely to deceive any person.
  • f. User Contributions must not promote any illegal activity, or advocate, promote, or assist in any unlawful act.
  • g. User Contributions must not cause annoyance, inconvenience, or needless anxiety or be likely to upset, harass, embarrass, alarm, or annoy any other person.
  • h. User Contributions must not impersonate any person, or misrepresent your identity or affiliation with any person or organization.
  • i. User Contributions must not promote commercial activities or sales, such as contests, sweepstakes, sales promotions, barter, or advertising.
  • j. User Contributions must not create the impression that your User Contributions come from or are endorsed by us or any other person or entity, if that is not the case.

We reserve the right to remove or reject any User Contributions for any reason, including if they violate any of the Content Standards or our Terms of Use. We also reserve the right to take legal action and cooperate with law enforcement in response to any illegal or unauthorized use of the Site or its Interactive Services. Ultimately, users are fully responsible for the legality, accuracy, and appropriateness of any User Contributions they post on the Site.

8. WARRANTY DISCLAIMER

The Site is provided on an “as is” basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are imposed by and incapable of exclusion, restriction or modification under the laws applicable to these Terms of Use.

9. Indemnification and Defense

Indemnification means that you agree to protect, defend and hold harmless BestForPets and its officers, directors, owners, employees, agents, information providers, affiliates, licensors and licensees (collectively, the “Indemnified Parties”) from any legal claims or costs that may arise. You agree to pay for any and all liability and costs, including reasonable attorney’s fees, incurred by the Indemnified Parties in connection with any claim arising out of:

  • (a) any User Contributions you make; or
  • (b) any breach of these Terms of Use by you or any user of your account, including any representations, warranties, and covenants contained in these Terms of Use.

If any claim arises, you will cooperate fully and reasonably in defending it. BestForPets has the right to assume the exclusive defense and control of any matter subject to indemnification by you at its own expense.

10. Limitation of Liability

Use of BestForPets.org is at your own risk. BestForPets, its subsidiaries, divisions, affiliates, agents, representatives, and licensors (including independent contractor contributors) shall not be liable for any loss or injury, or for any direct, indirect, incidental, consequential, special, punitive, or similar damages arising out of your access or use of, or your inability to access or use, the Site and the information available on the Site or arising out of any action taken in response to or as a result of any information available on the Site. By using the Site, you waive any and all claims against BestForPets and its subsidiaries, divisions, affiliates, agents, representatives, and licensors (including independent contractor contributors) arising out of your use of the Site and the information available on it.

11. Third-Party Links, Advertisements, Websites, and Content

We want to make it clear that we do not review or monitor any third-party websites, advertisements, or other media that are linked to or available through the BestForPets Site. As a result, we cannot be held responsible for the content of any such third-party advertisements or linked websites. Therefore, before purchasing any third-party products or services described on the Site, we strongly recommend that you verify pricing, product quality, and any other information that is necessary to make an informed purchase.

Please note that neither BestForPets nor its parent company, subsidiaries, divisions, affiliates, agents, representatives, or licensors will be held liable for any issues that may arise from your purchases of third-party products or services based on the information provided on the Site. Furthermore, we will not receive or review any complaints regarding such purchases.

12. Disputes

These Terms of Use and any disputes arising from or related to the BestForPets Site will be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict of law principles. In the event of any dispute, you agree to submit to the exclusive jurisdiction and venue of the courts located in the State of New York, County of New York. Any claim or cause of action you may have arising from or relating to these Terms of Use or the Site must be brought within one (1) year from when the cause of action first accrued. If you fail to do so, such claim or cause of action shall be forever barred, and you agree to waive any such claim or cause of action after that date.

13. Waiver and Severability

Pet owners who access or use the BestForPets website are bound by these Terms of Use. PetKeen's failure to enforce any provision of these Terms of Use shall not be considered a waiver of that provision or any other provision. If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified or eliminated to the minimum extent necessary to make the remaining provisions of these Terms of Use enforceable and valid.

At BestForPets, we are committed to complying with the Americans with Disabilities Act (ADA) to ensure equal access and opportunity for all users. Here are some ways we strive to achieve ADA compliance:
